Terms of Service

1. Acceptance of Terms

By downloading, installing, or using Pulse (“the App”), you agree to be bound by these Terms of Service (“Terms”). These Terms constitute a legal agreement between you and Pulse (“we,” “us,” “our”). If you do not agree to these Terms, do not access or use the App.

By using our services, you represent and warrant that: (a) you are at least 16 years of age, or have permission from a parent or guardian; (b) you have the legal capacity to enter into a binding agreement; and (c) your use of the App complies with all applicable laws and regulations.

2. Description of Service

Pulse is a social platform that connects runners with nearby group running sessions. The App allows users to discover sessions on a map, create and join group runs, communicate with other runners, and build a local running community. Pulse facilitates connections but does not organize, supervise, or control any running sessions.

3. Account Registration

You must create an account to use Pulse. You agree to provide accurate, current, and complete information during registration and to keep your profile updated. You are responsible for maintaining the confidentiality of your login credentials. You must not share your account with others or create multiple accounts. We reserve the right to disable any account at any time.

4. User Conduct

You agree to use Pulse in accordance with our Community Guidelines. You must not:

  • Harass, bully, threaten, intimidate, or abuse other users
  • Post offensive, obscene, discriminatory, or hateful content
  • Impersonate another person or create fake profiles
  • Use the App for commercial solicitation, spam, or fraud
  • Share other users' personal information without consent
  • Attempt to reverse-engineer, hack, or compromise the App's security
  • Use the App for any illegal purpose

Violation of these rules may result in warnings, account suspension, or permanent termination at our sole discretion.

5. Running Sessions & In-Person Meetups

Pulse enables users to organize and join group running sessions. By participating in any session, you acknowledge and agree to the following:

  • User Responsibility: Pulse does not conduct background checks on users. You are solely responsible for your safety and interactions with other users.
  • Assumption of Risk: Running is a physical activity with inherent risks including injury, illness, or accident. You voluntarily assume all risks associated with participating in running sessions.
  • No Supervision: Pulse does not supervise, monitor, or control in-person sessions. Session creators are not agents or employees of Pulse.
  • Exercise Caution: Always meet in public places, inform someone of your plans, and review our Safety Tips before participating.

6. User Content

You retain ownership of content you submit to Pulse. By posting content, you grant us a worldwide, royalty-free, non-exclusive license to use, display, reproduce, and distribute that content in connection with operating the App. You are solely responsible for your content and must not post anything that infringes on the rights of others.

7. Subscriptions & Purchases

Pulse offers optional premium features through subscriptions (Pulse+). Subscriptions are managed through the Apple App Store or Google Play Store and are subject to their respective terms and refund policies. Subscriptions automatically renew until cancelled. Cancelling a subscription does not delete your account.

8. Intellectual Property

All intellectual property in the App, including but not limited to the design, code, graphics, logos, and trademarks, is owned by Pulse and protected by applicable intellectual property laws. You may not copy, modify, distribute, or create derivative works from any part of the App without our express written consent.

9. Disclaimer of Warranties

Pulse is provided on an “AS IS” and “AS AVAILABLE” basis without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the App will be uninterrupted, error-free, or secure.

10. Limitation of Liability

To the maximum extent permitted by law, Pulse shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, personal injury, or damages arising from your participation in running sessions. Our total aggregate liability shall not exceed $100 USD or the amount you paid to Pulse in the preceding 12 months, whichever is greater.

11. Indemnification

You agree to indemnify, defend, and hold harmless Pulse and its officers, directors, employees, and agents from any claims, damages, or expenses arising from your use of the App, your violation of these Terms, or your interactions with other users.

12. Termination

You may delete your account at any time through the App settings. We reserve the right to suspend or terminate your account at any time for violating these Terms or our Community Guidelines, without prior notice and without refund of any subscription fees.

13. Changes to Terms

We may update these Terms from time to time. Material changes will be communicated through the App or via email. Your continued use of Pulse after changes constitutes acceptance of the updated Terms. If you do not agree to any changes, you must stop using the App.
